COMUNICADO Nº 007-2009/OSCE-PRE
INSTITUCIONES DEL SISTEMA FINANCIERO Y DE SEGUROS AUTORIZADAS PARA EMITIR CARTAS FIANZA y PÓLIZAS DE CAUCIÓN
El ORGANISMO SUPERVISOR DE LAS CONTRATACIONES DEL ESTADO (OSCE), recuerda a las Entidades, proveedores y, en general, a los usuarios del sistema de contratación pública que, de acuerdo con el artículo 155° del Reglamento de la Ley de Contrataciones del Estado, aprobado mediante Decreto Supremo N° 184-2008-EF, publicado el 01.01.09 en el Diario Oficial “El Peruano”, que las garantías que acepten las Entidades sólo podrán ser efectuadas por empresas bajo el ámbito de la Superintendencia de Banca, Seguros y Administradoras Privadas de Fondos de Pensiones o que estén consideradas en la lista actualizada de bancos extranjeros de primera categoría que periódicamente publica el Banco Central de Reserva del Perú.
Asimismo, dichas garantías deben cumplir con las características señaladas en el artículo 39° de la Ley de Contrataciones del Estado, aprobada por Decreto Legislativo N° 1017.
En ese sentido, mediante los oficios múltiples N° 19151-2009-SBS, N° 23926-2009-SBS Y Oficio N° 36258-2009-SBS, la Superintendencia de Banca, Seguros y Administradoras Privadas de Fondos de Pensiones detalla la relación de instituciones del Sistema Financiero y de Seguros, bajo su supervisión, que se encuentran autorizadas a emitir CARTAS FIANZA Y PÓLIZAS DE CAUCIÓN, de acuerdo a lo señalado por la Ley General del Sistema Financiero y del Sistema de Seguros y Orgánica de la Superintendencia de Banca y Seguros, Ley N° 26702:
